1. Scope of Application

These General Terms and Conditions apply exclusively to orders placed by consumers through the online shop of Janssen Cosmetics GmbH. The online shop offers cosmetic products for personal use.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or independent professional activity. Separate terms and conditions apply to orders placed by beauty institutes, commercial customers, resellers and distributors.

Deliveries are made exclusively to countries that can actually be selected as delivery countries during the ordering process. Germany and France are the main delivery countries. The currently available delivery countries are also displayed on the relevant information pages of the online shop. JANSSEN COSMETICS reserves the right to change the list of countries to which deliveries are made at any time, provided that contracts already concluded are not affected. For countries served by a foreign representative, the customer may, where technically possible, be automatically redirected to the shop responsible for that country.

If an order is inadvertently placed in the German or French shop from a country served by a foreign representative, JANSSEN COSMETICS may reject the order by email within five working days of receipt. In this case, no contract is concluded. Any payments already made will be refunded without delay; provisional payment authorisations will be cancelled.

In addition to these General Terms and Conditions, the information available in the online shop concerning Ordering, Payment, Delivery, Withdrawal, Contact and Data Protection shall apply insofar as such information becomes part of the contract or contains legally required consumer information.

2. Contracting Party

The purchase contract is concluded with:

Janssen Cosmetics GmbH

Pontsheide 36

52076 Aachen

Germany

Telephone: +49 (0) 2408 7046-0

Email: [email protected]

3. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to the customer to submit an offer to purchase.

The customer may initially place products in the shopping basket without obligation. By clicking the "Place order with obligation to pay" button, the customer submits a binding offer to purchase the goods contained in the shopping basket. Receipt of the order is confirmed to the customer electronically without delay. This automatic order confirmation exclusively confirms receipt of the order and expressly does not constitute acceptance of the contractual offer.

The contract is concluded only upon an express declaration of acceptance or a dispatch confirmation in which JANSSEN COSMETICS declares acceptance of the specific order. Acceptance or dispatch confirmation generally takes place within five working days of receipt of the order.

A payment authorisation, payment charge or payment request prior to express acceptance does not, in itself, constitute conclusion of the contract. Payment processing is generally initiated only after the contract has been concluded. If a provisional payment authorisation is required beforehand for technical reasons, the amount will not be definitively charged; if the offer is not accepted, the authorisation will be cancelled without delay or any amount already collected will be refunded without delay.

If JANSSEN COSMETICS does not accept the offer within the above-mentioned period (5 working days), the customer can no longer expect acceptance unless JANSSEN COSMETICS expressly informs the customer otherwise. The customer's statutory rights remain unaffected.

4. Input Errors

Before submitting the order, the customer may review and correct their entries at any time, in particular by removing products from the shopping basket or changing information using the functions provided for this purpose during the ordering process. Input errors can be corrected using the usual keyboard, mouse and browser functions (e.g. the browser's "Back" button). They can also be corrected by cancelling the ordering process prematurely, closing the browser window and repeating the process.

After clicking the "BUY NOW" button, the customer can no longer make corrections themselves.

5. Contract Language, Contract Text and Incorporation of the General Terms and Conditions

German and French are available for the conclusion of contracts. If the contract is concluded via the German version of the online shop, German is the contract language. If the contract is concluded via the French version of the online shop, French is the contract language.

For orders placed via the English version of the EU online shop, English is the contract language. This applies to all countries supplied via the EU online shop, unless mandatory statutory language requirements of the respective delivery country provide otherwise.

The General Terms and Conditions applicable to the respective contract, the statutory withdrawal instructions including the model withdrawal form, the order details and an acceptance or dispatch confirmation will be provided or transmitted in the respective contract language.

The customer may access, save and print these General Terms and Conditions in the online shop. They are incorporated into the contract by allowing the customer to review the applicable General Terms and Conditions before submitting the order and by obtaining the customer's agreement to their application during the ordering process.

JANSSEN COSMETICS stores the contract text. The order details and the applicable General Terms and Conditions are transmitted to the customer after submission of the order by email or on another durable medium. JANSSEN COSMETICS does not make the contract text accessible beyond this. If the purchase was made via a customer account in the online shop, the customer can view their orders and the associated order details there. The contract text is not necessarily permanently accessible to the customer via the customer account after conclusion of the contract; the customer should therefore save the documents themselves.

6. Customer Account and Registration

Where technically provided for, orders may be placed either through a customer account or as a guest order. When registering a customer account, the customer undertakes to provide the requested information completely and truthfully. Access credentials for the customer account must be treated confidentially and protected against access by third parties. JANSSEN COSMETICS reserves the right to block or delete customer accounts in the event of misuse, violations of these General Terms and Conditions or incorrect information.

7. Products and Product Information

The online shop offers cosmetic products for consumers. The essential characteristics of the respective goods are set out on the product detail page and, where applicable, on the product packaging.

The product detail pages contain, in particular, the information required by law, insofar as applicable to the specific product, including ingredients, contents or nominal quantity, instructions for use, warnings and safety instructions, information about the manufacturer or responsible person, and other legally required product information. The agreed product characteristics and the information provided in the online shop in this regard are decisive for the characteristics of the goods.

Differences between product images and the goods delivered may arise, in particular, from technical representations, different screen displays, packaging changes or adjustments to the product range, provided that the difference is reasonable for the customer and does not concern an agreed product characteristic.

Product photographs, advertising images, campaign images and application images are provided for illustrative purposes. They may have been digitally edited or created or optimised using artificial intelligence. Such images serve as visual representations and inspiration and do not constitute a binding agreement regarding product characteristics. They may not replace any binding product characteristics, efficacy claims or other properties arising from the product description, ingredients, instructions for use, warnings or product packaging. The product description, ingredients, instructions for use and information on the product packaging are binding.

8. Prices, Unit Prices and Shipping Costs

The prices displayed in the online shop at the time the order is submitted shall apply. All prices include the applicable statutory value added tax.

Where required by law, unit prices are also stated. Unit prices are displayed on the respective product detail page or during the ordering process.

Any additional shipping costs are displayed to the customer during the ordering process and can also be accessed on the shipping page of the online shop. The total price, including shipping costs, is shown before the order is submitted.

9. Payment

The payment methods displayed during the ordering process are available in the online shop. Depending on the delivery country, order value, availability and the result of a check by the respective payment service provider, the following payment methods in particular may be offered:

  1. PayPal or other payment methods offered via PayPal

  2. Credit card, in particular Visa and Mastercard

  3. SEPA direct debit via a payment service provider used for this purpose

  4. Payment 30 days later, provided that this payment method is offered during the ordering process via the selected payment service provider (PayPal Plus or Klarna)

  5. Klarna purchase on account

  6. Klarna instant bank transfer or a corresponding current Klarna payment method

There is no entitlement to a particular payment method. JANSSEN COSMETICS reserves the right to exclude individual payment methods depending on the delivery country, order value, availability or the result of a check by the payment service provider.

Payment methods such as purchase on account and payment 30 days later may only be offered to customers of legal age and only subject to the conditions of the respective payment service provider.

The use of certain payment methods may require an identity or creditworthiness check. JANSSEN COSMETICS has no influence over the result of such checks.

When paying via external payment service providers, in particular PayPal or Klarna, the terms and conditions and data protection information of the respective payment service provider shall also apply.

Further information on the available payment methods can be accessed on the Payment page of the online shop.

10. Delivery, Delivery Period and Unavailability

Delivery is made to the delivery address specified by the customer during the ordering process, provided that this address is located in a delivery country that can be selected during the ordering process. The billing address and delivery address must be located in the same delivery country unless otherwise specified during the ordering process. Collection in person is not possible.

The delivery time is stated on the respective product detail page and during the ordering process. It generally begins upon conclusion of the contract. In the case of advance payment, the delivery period begins upon receipt of payment, unless otherwise stated. Delivery times, shipping costs, thresholds for free shipping and possible delivery restrictions can also be accessed on the Delivery page of the online shop.

JANSSEN COSMETICS is entitled to make partial deliveries insofar as this is reasonable for the customer. The customer will not incur any additional shipping costs as a result, unless expressly agreed otherwise.

If goods are unavailable despite careful selection and proper ordering from the supplier, through no fault of JANSSEN COSMETICS, the customer will be informed without delay. Any payments already made will be refunded without delay. The customer's statutory rights remain unaffected.

11. Statutory Right of Withdrawal for Consumers

Consumers are generally entitled to a statutory right of withdrawal. The current statutory withdrawal instructions, including the model withdrawal form, are provided in a separate document. This document forms part of the consumer information and is made accessible to the customer before conclusion of the contract and transmitted to the customer on a durable medium after conclusion of the contract.

The details, in particular the withdrawal period, exercise of the right of withdrawal, consequences of withdrawal, reimbursement and return shipment, are governed exclusively by the current statutory withdrawal instructions (Withdrawal Instructions). The withdrawal instructions are not replaced by differing or supplementary information in these General Terms and Conditions.

The right of withdrawal may be excluded pursuant to Section 312g (2) No. 3 of the German Civil Code (BGB) if the goods are in fact sealed goods which are not suitable for return for reasons of health protection or hygiene and the seal has been removed after delivery. The exclusion applies only if the statutory requirements are met in the individual case.

The customer shall bear the costs of return shipment only in accordance with the current statutory withdrawal instructions.

12. Returns

Information on the returns procedure can be accessed on the Withdrawal page of the online shop.

The customer is requested to package returned goods carefully and, where possible, return the goods complete, including accessories and original packaging. This is not a prerequisite for the effective exercise of the right of withdrawal or the assertion of statutory claims, unless otherwise provided by law.

For returns resulting from withdrawal, the provisions of the withdrawal instructions shall apply.

For returns due to defects, complaints or suspected product intolerances, the customer's statutory rights and the organisational instructions provided for this purpose in the online shop shall apply.

For questions concerning a defect and the handling of claims relating to defects, please contact our customer service at [email protected].

13. Product Intolerances and Skin Reactions

If a customer experiences a skin reaction or suspects a product intolerance after using a product, they should initially discontinue use and contact JANSSEN COSMETICS as soon as possible at [email protected]. In the event of severe or persistent symptoms, the customer should seek medical advice.

To enable an appropriate assessment of the case, JANSSEN COSMETICS may ask the customer to complete a questionnaire concerning product use, skin reaction, product history and other relevant circumstances. Depending on the individual case, information about the product used, the batch number, proof of purchase, the frequency and manner of use, and information about products used simultaneously may be helpful.

JANSSEN COSMETICS may also ask the customer to provide photographs of the affected areas of skin or to answer a questionnaire, insofar as this is necessary and appropriate for assessing the individual case, product safety, quality assurance or statutory documentation and reporting obligations.

The submission of photographs, questionnaires, health information or other additional information is not a prerequisite for exercising statutory rights relating to defects, the right of withdrawal or other statutory claims. However, a lack of cooperation may mean that the circumstances cannot be fully clarified.

The processing of personal data and, in particular, health data is carried out exclusively in accordance with the applicable data protection regulations and the privacy policy available in the online shop. A refund, replacement delivery or other goodwill solution will be provided following an assessment of the individual case. The customer's statutory claims remain unaffected.

14. Retention of Title

The goods remain the property of Janssen Cosmetics GmbH until payment has been made in full.

15. Transport Damage

If goods are delivered with obvious transport damage, the customer is requested to report this to the delivery agent as soon as possible and to inform JANSSEN COSMETICS without delay.

Failure to make such a complaint or establish contact has no effect on the customer's statutory rights, in particular their statutory rights relating to defects. However, the customer thereby assists JANSSEN COSMETICS in asserting claims against the shipping service provider.

16. Statutory Warranty Rights

The statutory provisions governing liability for defects shall apply.

Information on any additional guarantees and their conditions can be found in the respective product description or in separate guarantee information in the online shop. Statutory rights relating to defects are not restricted by any guarantee.

17. Liability

JANSSEN COSMETICS shall be liable without limitation for damage resulting from injury to life, body or health caused by a breach of duty on the part of JANSSEN COSMETICS, a legal representative or a vicarious agent.

JANSSEN COSMETICS shall also be liable without limitation in cases of intent and gross negligence and in accordance with the statutory provisions of the German Product Liability Act.

In the event of a slightly negligent breach of essential contractual obligations, JANSSEN COSMETICS shall be liable only for damage that is typical of the contract and foreseeable. Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose compliance the customer may regularly rely.

In all other respects, liability on the part of JANSSEN COSMETICS is excluded to the extent permitted by law.

18. Data Protection

JANSSEN COSMETICS processes the customer's personal data in accordance with the applicable data protection regulations. The privacy policy is available in the online shop in its currently valid version. Further information on the nature, scope and purpose of processing and on the customer's rights can be found in the privacy policy.

19. Consumer Dispute Resolution

JANSSEN COSMETICS is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body.

20. Applicable Law and Final Provisions

German law shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods. For consumers, this choice of law shall apply only insofar as it does not deprive them of the protection afforded by mandatory statutory provisions of the country in which the consumer has their habitual residence. This applies in particular to consumers habitually resident in France or another Member State of the European Union.

Should individual provisions of these General Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The statutory provisions shall apply in place of the invalid provision.
